This policy sets out how Capstar Services (UK) Limited (“Capstar”) uses and protects any information that you give us or that we may collect or otherwise process in the course of your using our website or any of our ground transportation services or a dedicated driver for ground transportation services. Capstar is committed to ensuring that your privacy is protected and is the controller of your personal data for data protection purposes.

Capstar may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from June 2019.

Who processes your information?

For the purposes of relevant data protection legislation, Capstar maybe either the Data Controller or Data Processor of the personal information you provide to us. When we act as Data Controller, we will determine the purposes for which, and the manner in which, any personal data relating to learners, apprentices, partners or other stakeholders is to be processed. In other circumstances our clients will act as Data Controller and will make these decisions and we will act as a processor.

Why do we collect and use your information?

Capstar may collect and use personal data of delegates, students, partners, clients, our employees or other stakeholders, and we may also receive information regarding them from their employer, other training providers, partners, and previous employers where you are applying for employment at Capstar. We collect and use personal data in order to meet legal requirements and legitimate interests set out in Data Protection Legislation, including those in relation to the following:  

·    Article 6 and Article 9 of the GDPR

Which data is collected?

The categories of information that Capstar may collect, hold and share include the following:

·       Personal information – e.g. names, addresses, dates of birth, telephone numbers and email addresses

·       Characteristics – e.g. ethnicity, language, nationality, country of birth

·       Attendance information when attending as a delegate or student

·       Assessment information – e.g. Exam and/or Functional Skills results when taking our courses

·       Relevant medical information e.g. if you are an employee

·       Relevant information regarding personal and business premises and vehicles of clients requiring quotations or services. When relevant, as in cases of security services, we may also require information that is pertinent to ensuring client safety, e.g: school information, children’s name, etc.

  • information about the requested Journey (e.g. pick up/drop off addresses) or any Package to be collected or sent;

  • name of passengers and any specific travel requirements such as disability requirements, whether minors are travelling, VIP status or any other information contained in the Booking Request (with respect to ground transportation services) or in the Specific Details (with respect to the supply of a dedicated driver);

  • credit or debit card details;

  • demographic information such as postcode, preferences and interests; and

  • other information relevant to customer surveys and/or offers.

 

When collecting data, Capstar will inform you whether you are required to provide this data or if your consent is needed. Where consent is required, Capstar will provide you with specific and explicit information with regards to the reasons the data is being collected and how the data will be used.    

How long is your data stored for?

Personal data relating to delegates, students, partners, our employees and other stakeholders is stored in line with the company’s GDPR Data Protection Policy.  

In accordance with Data Protection Legislation, Capstar does not store personal data indefinitely; data is only stored for as long as is necessary to complete the task for which it was originally collected.  

How do we use your personal information?

Your personal information is used by Capstar to meet its legal requirements and legitimate interests including fulfilling its contractual obligations to its clients and partners and to meet its statutory responsibilities.

The personal data of delegates, students, partners, clients, our employees or other stakeholders is collected and used for the following reasons:  

·         To support learner and apprentice learning

·         To monitor and report on learner and apprentice progress

·         To provide appropriate Information, Advice and Guidance

·         To assess the quality of our service

·         To comply with the law regarding data sharing

·         To safeguard our learners, apprentices, employees, partners and other stakeholders

·         To ensure compliance with our statutory, contractual and regulatory obligations  

·         to set up and administer your account;

·         to carry out our obligations arising from any bookings that you have made with us or other services provided to you;

·         to communicate with you;

·         to investigate any complaints or queries with respect to our website or services;

·         to conduct surveys and market research;

·         to improve and develop our website and other products and services and provide you with details of our promotions, products and services (where we have the appropriate permissions to do so);

·         to gather management information to form statistical and trend analysis; and

·         to meet legal and regulatory purposes.

·         We may also use a live time GPS tracker system in order to ensure that your journey is as efficient and as safe as possible, which will be monitored from our office.

 

Your information will be securely destroyed after it is no longer required for these purposes.

Will my information be shared?

Your information may be shared with third parties for education, training, employment and well-being related purposes, including for research. Third parties may include statutory bodies, awarding organisations, your employer and training partners. This will only take place where the law allows it and the sharing is in compliance with Data Protection Legislation including GDPR.

Capstar has robust processes in place to ensure the security and confidentiality of any data shared with third-parties. Where Capstar transfers data to a third-party sub-processor, the same data protection standards that Capstar upholds are imposed on the sub-processor.

Capstar will not share your personal information with any third parties without your consent, unless the law allows us to do so, for example, under Article 6(f) (Legitimate Rights) of the GDPR.

What are your rights?  

Delegates, students, partners, clients, our employees and/or other stakeholders have the following rights in relation to the processing of their personal data.  

You have the right to:

·       Be informed about how Capstar uses your personal data

·       Request access to your personal data that Capstar holds

·       Request that your personal data is amended if it is inaccurate or incomplete

·       Request that your personal data is erased where there is no compelling reason for its continued processing

·       Request that the processing of your data is restricted

·       Object to your personal data being processed

·       Withdraw your consent at any time where the processing of your data is based on your prior explicit consent.

How we use cookies

A cookie is a small file that asks permission to be placed on your computer’s hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

We use traffic log cookies to identify which pages are being used. This helps us analyse data about web page traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system.
Overall, cookies help us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us.
